USING WHYSY KIDS
Terms of Service
1. Acceptance of Terms
By downloading, installing, or using WhySy Kids (the "App"), you agree to these Terms. A parent or legal guardian creating or controlling a family account confirms that they have read and accepted these Terms. If you do not agree, do not use the App.
2. Description of Service
WhySy Kids is an AI-powered educational application designed to help children explore questions through age-appropriate stories, images, audio, and interactive learning experiences under adult supervision. AI-generated content can be incomplete or inaccurate and should not replace professional advice or adult judgement.
3. Eligibility and Parental Responsibility
The App is intended for children aged 3-12 under the supervision of an adult who is authorised to create the family account. The parent or guardian is responsible for account activity, child-profile management, consent choices, and deciding whether generated content is appropriate for the child.
4. Accounts and Security
You must provide accurate account information, maintain the confidentiality of credentials, and promptly report suspected unauthorised access. The App may support email/password or approved third-party sign-in methods. Contact [email protected] if you believe an account has been compromised.
5. Subscriptions and Payments
Free and paid features may be offered. Paid subscriptions and other purchases are processed by the applicable app store and are subject to its billing, renewal, cancellation, and refund rules. Prices, currencies, trials, and available plans are shown before purchase. A subscription can be managed through the app-store account used to purchase it.
6. User Content
You retain ownership of photos, voice recordings, questions, and other content you submit. You grant Whysy Inc. a limited, non-exclusive licence to host, process, transform, and display that content only as needed to operate and improve the requested features, maintain safety, and comply with law. Do not submit content that is unlawful, harmful, abusive, or infringes another person's rights.
7. Intellectual Property
The App, website, brand, software, artwork, and other service materials are owned by Whysy Inc. or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership. You may use the service only for personal and family educational purposes.
8. Prohibited Conduct
You may not misuse the service, bypass security or parental controls, interfere with other users, scrape or automate access without permission, upload malicious code, use the service for unlawful purposes, or attempt to reverse-engineer the App except where applicable law expressly permits it.
9. Suspension and Account Deletion
We may limit or suspend access when reasonably necessary to protect users, investigate abuse, comply with law, or maintain service security. A parent or guardian may request account deletion through the account deletion page. Deletion is subject to identity verification and any legally required retention.
10. Disclaimers
The service is provided "as is" and "as available" to the extent permitted by law. We do not guarantee uninterrupted availability or that AI-generated content will always be accurate, complete, or suitable for every child. Parents and guardians should review content and supervise use.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Whysy Inc. is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
12. Changes to These Terms
We may update these Terms as the service changes. Material changes will be communicated through the App, website, or guardian account email as appropriate. Continued use after the effective date means you accept the updated Terms, where permitted by law.
